Studies have found that roughly one-third of commercial truck drivers have mild to severe sleep apnea. Because sleep apnea affects a driver’s sleep, it also affects a driver’s daytime alertness and performance. This presentation will examine the causal effect of sleep apnea in accidents, including recommendations for monitoring and prevention, review the regulatory attempts to govern sleep apnea and discuss defense strategies when faced with sleep apnea claims, including the admissibility of experts in the field.
