JSH Attorneys Prevailed By Motion To Dismiss In Professional Negligence Matter

PHOENIX, AZ (February 28, 2017) – On behalf of their clients, Dr. Michael Bauer and Dr. Denis Furr, Jeremy Johnson, Heather Bushor and Justin Ackerman of  Jones, Skelton & Hochuli, prevailed on two motions to dismiss in a multi-million dollar professional liability negligence matter pending in Arizona Superior Court, Maricopa County. Thirty-five Plaintiffs sued Drs. Bauer and Furr (and 13 other defendants) for their role in a “body broker” scheme where it was alleged they mishandled and illegally sold the remains of Plaintiffs’ deceased loved ones.   Defendants claimed that the Arizona plaintiffs were barred from suing them in Arizona based on lack of personal jurisdiction with the State of Arizona. This was premised on the fact that Drs. Furr and Bauer, who worked out of an Illinois facility, had no connection or involvement with any Arizona body donors. After oral argument, Judge Dawn Bergin held the first motion to dismiss in abeyance and allowed Plaintiffs leave to amend their complaint.  Plaintiffs amended their complaint and alleged additional facts that Dr. Bauer was the alter ego of an Arizona corporation and could be sued in Arizona. After a second motion to dismiss on jurisdiction was filed, Judge Bergin granted the motion.  Jones Skelton was the only firm to prevail on a motion to dismiss despite similar motions being filed by three other defendants.

Associate Heather Bushor has been practicing law for 8 years. Associate Justin Ackerman graduated as the Valedictorian of his class from Arizona Summit Law School, Mr. Ackerman worked as a Law Clerk for the Honorable Michael J. Brown in Division One of the Arizona Court of Appeals. Mr. Ackerman was also awarded ten CALI awards for receiving the highest grade in a class during his time at Arizona Summit Law School and had his law review article selected for publication.
