Nichols v. Darson – Jones, Skelton & Hochuli, PLC is pleased to announce that Partner, Steve Bullington, received a unanimous defense verdict. This case alleged that medical malpractice emerged out of the care and treatment provided to Plaintiff by the Defendant, a urologist, for Plaintiff’s prostate cancer.  Plaintiffs, husband and wife, alleged that the Defendant was negligent in failing to provide reasonable and prudent care and treatment to Plaintiff when Defendant urologist performed a robotic-assisted prostatectomy on Plaintiff.  There were numerous complications encountered during the surgery and it was ultimately aborted before the prostate was removed.  The Plaintiff underwent an additional surgery and radiation therapy which Plaintiffs claimed would not have been necessary if the Defendant had properly performed the 6/14/2012 surgery.  Plaintiffs claimed pain and suffering, loss of consortium, loss of enjoyment of life as a result of the alleged negligence as well as medical bills and expenses of $466,000.  The case was tried in Maricopa County Superior Court before the Honorable Daniel Martin.  After a six day trial, the jury returned a unanimous defense verdict on 11/23/2016.
